2. Information We Collect

We collect information in three main ways: information you provide, information collected automatically, and information from third parties.

2.1 Information You Provide Directly

  • Contact details such as your name, email address, postal address, phone number, and country.

  • Account and profile details such as username, password, profile photo, biography, and preferences.

  • Payment‑related information (for example, subscription tier, payment method type, billing address), which is processed by our payment processors (such as Stripe and PayPal) and not stored by Proud American Studios in full card form.

  • Content you submit, including comments, posts, messages, uploaded media, support requests, survey responses, and any materials you submit for consideration (such as trailers or other projects), which may also be governed by separate submission terms.

  • Marketing preferences, affiliate information (for example, referral links and IDs), and communication choices.

2.2 Information Collected Automatically

When you use the Services, we and our service providers automatically collect certain information using cookies, pixels, SDKs, and similar technologies, such as:

  • Device and usage information (IP address, browser type, device identifiers, operating system, language, time zone).

  • Activity data (pages viewed, links clicked, videos watched, features used, session duration, referring/exit pages).

  • Approximate location information derived from your IP address.

2.3 Information From Third Parties

We may receive information about you from:

  • Affiliate platforms (for example, Rewardful) when you sign up as an affiliate or arrive via an affiliate link.

  • Analytics and advertising partners (for example, Google Analytics and Meta Pixel) that provide insights about how users interact with our content and ads.

  • Payment processors and app stores that send us confirmation of purchases, refunds, and subscription status.

  • Community and streaming platforms (for example, Uscreen) that help us operate accounts, community spaces, and OTT apps.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and operate the Services – including hosting and streaming video, managing memberships, enabling community features, processing payments, and providing customer support.

  • Personalize your experience – such as recommending content, remembering your preferences, and tailoring communications.

  • Communicate with you – including sending service‑related messages (account notices, security alerts, billing updates) and, where permitted, marketing communications about shows, events, offers, or affiliate opportunities.

  • Run our affiliate and referral programs – including tracking referrals, attributing sign‑ups, and paying commissions through tools such as Rewardful.

  • Improve and secure the Services – including monitoring performance, analyzing usage trends, testing features, preventing fraud, and enhancing security.

  • Comply with laws and enforce our terms – including recordkeeping, handling legal requests, resolving disputes, and protecting the rights of Proud American Studios, our community, and others.

We may aggregate or de‑identify information so that it can no longer reasonably identify you and may use or share such information for any lawful purpose.

4. Cookies, Analytics, and Advertising

4.1 Cookies and Similar Technologies

We and our partners use cookies, pixels, scripts, and similar technologies to:

  • Keep you signed in and remember your settings.

  • Understand which pages and videos are most popular.

  • Measure the effectiveness of our marketing campaigns.

You can typically control cookies through your browser settings. If you disable cookies, some features of the Services may not function properly.

4.2 Analytics

We use analytics tools such as Google Analytics to understand how visitors use the Services and to improve our content and user experience. These tools may use cookies and collect information such as your IP address and device identifiers, which may be transmitted to and stored by the analytics provider in various countries, including the United States.

4.3 Advertising and Retargeting

We may work with advertising partners (for example, Meta and other platforms) that use cookies, pixels, and similar tools to show you relevant ads and measure campaign performance. This may include retargeting based on your interactions with our Services or our ads.

Where required by law, we will request your consent before using cookies or similar technologies for advertising and will provide ways to opt out of certain tracking.

5. How We Share Information

We do not sell your personal information for money. We may share information in the following situations:

5.1 Service Providers

We share information with trusted service providers that perform services on our behalf, such as:

  • Hosting, streaming, and OTT services (for example, Uscreen).

  • Website, funnels, CRM, email, SMS, chat, support, survey, and webinar tools (for example, Go High Level).

  • Payment processors and billing providers (for example, Stripe, PayPal, and, in the future, platforms that integrate with Shopify).

  • Affiliate tracking and payouts (for example, Rewardful).

  • Analytics and advertising partners (for example, Google and Meta) for measurement and marketing.

These providers are allowed to use your information only to provide services to us and must protect it appropriately.

5.2 Community and Social Features

Within members‑only community areas hosted through Uscreen, your display name, profile image, posts, comments, reactions, and similar activity are visible to other members and to our team.

If we wish to feature your content (for example, testimonials, comments, or user‑generated video) in marketing campaigns or programming outside the community, we will obtain any additional permissions or releases that may be required.

5.3 Legal, Safety, and Business Transfers

We may disclose information when we believe it is necessary to:

  • Comply with applicable law, regulation, or legal process.

  • Respond to lawful requests from public or government authorities.

  • Protect the rights, property, or safety of Proud American Studios, our users, or the public.

  • Investigate and defend against legal claims.

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business, information may be transferred as part of that transaction.

6. Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy, including:

  • Operating your account and providing the Services.

  • Keeping transaction and billing records for seven (7) years for tax, accounting, fraud‑prevention, and audit purposes.

  • Complying with legal obligations and resolving disputes.

When information is no longer needed, we may delete it or de‑identify it in accordance with our data‑retention procedures.

7. Your Rights and Choices

We aim to provide meaningful privacy rights to users worldwide, subject to applicable law.

7.1 Access, Correction, and Deletion

You may have the right to:

  • Request access to the personal information we hold about you.

  • Request correction of inaccurate or incomplete information.

To exercise these rights, contact [email protected]. We may need to verify your identity or ownership of the account before responding.

7.2 Marketing Communications

You can manage marketing preferences as follows:

  • Email: Click the “unsubscribe” link in any marketing email or adjust your preferences in your account settings where available. We may still send you essential service or transactional messages.

  • SMS: SMS marketing is optional and requires your explicit opt‑in consent. You can reply STOP to any message to opt out of future marketing texts from that specific sender.

7.3 Cookies and Interest‑Based Ads

You can control certain cookies through your browser settings and may opt out of some interest‑based advertising through tools provided by industry groups and individual platforms.

8. Security

We use reasonable technical and organizational measures to protect personal information from unauthorized access, loss, misuse, or alteration. These measures may include encryption in transit, access controls, and monitoring for suspicious activity.

No system is perfectly secure. You are responsible for keeping your account credentials confidential and for notifying us promptly if you suspect unauthorized access to your account.

9. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that a child under 13 has provided us with personal information, we will take reasonable steps to delete it. If you believe a child has provided us with personal information, please contact us at [email protected].

By using the Services, you acknowledge that your information may be processed outside your country of residence, where privacy laws may be different from those in your jurisdiction, and you consent to such processing as described in this Policy.

11. Third‑Party Sites and Services

The Services may link to or integrate with third‑party websites, apps, and services that are not controlled by Proud American Studios (for example, external payment pages, social‑media platforms, or partner websites).

Your interactions with those third parties are governed by their own privacy policies and terms, not this Policy, and we are not responsible for their practices.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements.

When we make material changes, we will revise the “Last Updated” date at the top of this page and may provide additional notice (such as a banner or email) where required by law. Your continued use of the Services after the effective date of any changes means you accept the updated Policy.
